Respected Madam,

We hereby would like to file an appeal against the cancellation order no 11251 Dated 31.03.2017 for plot no. SP2-1 measuring  91,800 sqm at Industrial Area Neemrana – I issued under the signature of Mr Pradip Das, Sr Regional Manager.

With due respect, we hereby wish to mention that we have taken the possession of the plot no SP2/1 of  M/s Parakaram Technofab Ltd at industrial area Adroda on 05/06/2008 from Official liquidator and deed of conveyance entered into 21/09/2008. All types of liabilities over the unit upto the date of handing over the possession will be taken care of by the Official Liquidator and we will not be held liable to pay any liability over the Unit upto the date of handing over the possession of the unit.

We were under impression that as we took this property from Official liquidator through court order and we got the deed registered in our name by paying the requisite Stamp Duty, hence it will be treated as freehold and RIICO also never approached us hence it was confirmed to us that our plot will be treated as freehold.  However, we received intimation from Vidya for demand of economic rent and service charges vide letter no. 4008 dated 21/09/2016 only for the first time.

We requested for the waiver of interest charged to us and asked for the rectification of the demand note. Because we were never been intimated for this charges except by the first demand letter on 19th June, 2016. As the factory now is not in running condition, there is no inflow of funds. Hence, it was difficult to arrange such a large sum of amount immediately.  However, we deposited the Economic Rent for the entire period from the year 2004-05 to the year 2015-16 amounting to Rs. 63,235=84/- on 22.02.17 and also submitted cheque no. 308510 dated 12.03.2016 amounting to Rs. 37,64,305=00 for Service Charges and cheque no. 252521 dated 12.03.2017 amounting to Rs. 4,85,875=00 for Service Tax thereon.

We humbly requested to Vidya office, Adroda that as we are arranging the fund, kindly allow us some time as it was period of financial year end. We have arranged the funds now. But to our utter surprise, both the above cheques of Service Charges and Service tax returned to us on 9th May, 2017 along with the Cancellation Order no. 11251 dated 31.3.2017.

Hence, we are once again submitting the new cheques no. 252521 & 252522 amounting to Rs. 41,55,610=00 for Service Charges and Rs. 4,85,875=00 for service tax thereon respectively to your good office. We humbly pray hereby to kindly withdraw the cancellation letter under the given circumstances. We further request to kindly waive the interest charged in your last demand letter and kindly not to impose any Restoration and Transfer Charges on us.  We hereby firmly assure to regularly pay the Economic Rent and Service Charges along with Service Tax here onward.
