Dear Sir,
Sub: Notice against dishonour of Cheque No. 011111
and 022222 dtd. 14.07.2013 for Rs.100000/- and 200000 /- respectively drawn on ICICI Bank Limited, Mumbai
Khapoli Branch, 14/1 N S Road,
With reference to the above, we bring to your notice that a sum of Rs.300000/-
(Rupees Three lacs Only) is outstanding as on date.
You had paid a sum of Rs.300000/- (Rupees Three Lacs Only) against the
outstanding amount of Rs.300000/- (Rupees Three Lacs Only) by issuing Cheques
bearing No.011111 and 0222222 dtd. 14.07.2013 for Rs.100000/- and 200000 /-
respectively drawn on ICICI Bank Limited, Mumbai Khapoli Branch, towards
collection from your account. The said Cheques were deposited by us in our bank
namely SBI, Nariman Point Mumbai on 16.07.2013.
We regret to inform you that the above cheques have been returned unpaid
on 16.07.2013 with the remarks "Insufficient Funds" as per advice
received by us from our Banker on 16.07.2013, Copy of the Cheque Return Memo is
enclosed herewith for your reference.
You will certainly appreciate that dishonour of cheque is not a good
business practice and tarnishes your business image. We would request you that
in the interest of maintaining your goodwill, you must pay the entire amount
due to us.
Further, we hereby demand for payment of dishonoured cheque amounting to
Rs. 300000/- in terms of Section 138 of the Negotiable Instrument Act, 1881.
Please note that in case you fail to make the payment of the aforesaid amount
within 15 days on receipt of this notice, we reserve our right, without further
reference to you, to take recourse to the provision of Section 138 of the
Negotiable Instrument Act, 1881, the penalty for which includes imprisonment
for a term extending to one year or with fine which may extend twice the amount
of cheque or with both.
This is without prejudice to any of our right and contention.
